Paul Bernstein's BOOK on Landlord and Tenant
The "book" on landlord and tenant, particularly under the Chicago Residential Landlord and Tenant Ordinance, will be ever growing. To get this forum going and to generate discussion, over a reasonable period of time, I will publish here the various chapters of the current book and new chapters as they come to mind.

Security Deposit 'Issues'
Do you know that, in Chicago, if you are covered by the Chicago Residential Landlord and Tenant Ordinance (hereinafter called the 'RLTO'), that your security deposit must be placed into a separate, interest bearing account in a financial institution in Illinois? Did you know that you are to be paid interest on your security deposit every twelve months of the term of your lease, and that you are to get a receipt for your security deposit? And, did you know that damages are payable to a tenant if a landlord violates the requirements of the said RLTO? Here, we will discuss security deposits, the landlords' duties in that regard, and what tenants can do if the landlord does not follow the rules.

Evictions in Cook County
Evictions are a freightening experience for tenants. And, with almost 40,000 evictions every year in Cook County, Illinois, the trial in an eviction case is quick. Tenants without lawyers who attempt to 'try' their own case in the eviction courts are up against impossible barriers and seldom win their cases. This is not because they don't have a winning case, but because non-lawyers just do not know what they can do to defend themselves and how to do it.
Here, we will cover a wide range of topics for those facing eviction.

The implied warranty of habitability
The Implied Warranty of Habitability is a legal concept that is not known to tenants generally, but can be THE solution to problems tenants may have in regards to overcoming the effect of a landlord's five-day notice for non-payment of rent. Here, the concept will be described and discussed.

'Predatory Loans' are becoming a VERY common experience in our society. Your home may be the single-most significant asset you own, but if you get into financial trouble and can not pay your real estate taxes or face a foreclosure on your mortgage, it is not unlikely that 'predatory lenders' or 'investors' will approach you, late in the game, to 'save the day'.
